Terms and Conditions - End User

These Terms & Conditions ("Terms") govern the use of all Metpow Ltd products, services, platforms, software, firmware, websites, and connected hardware (collectively, "Metpow Services").
1. Who These Terms Apply To
These Terms apply to all users of Metpow Services, including but not limited to:
Direct customers
Website visitors
Mobile app users
Portal users (administrators, partners, clients)
End users of our hardware
Technical installers and maintenance users
Anyone interacting with www.metpow.com or its subdomains
By using any part of the Metpow Services, you agree to these Terms.

3. Scope of Licence
You are granted a non-exclusive, non-transferable, revocable licence to use the Metpow App, Portal, firmware, and connected services for personal, business, or administrative purposes in line with the intended functions.
Restrictions
You may not:
Copy, reverse-engineer, distribute, or resell the software or hardware.
Tamper with firmware or connected device telemetry.
Circumvent security mechanisms or misuse the systems.
Firmware updates and telemetry transmissions may occur automatically as part of normal Metpow operations.
4. Accounts
You are responsible for maintaining the confidentiality of your login credentials. Notify us of any unauthorised use immediately.
4.1 Instant or Anonymous Access
Some services may be accessed without prior account registration (e.g., via QR code, kiosk, or SMS link). In such cases, you may still be identified via your phone number or payment method. By using the service, even anonymously, you agree to be bound by these Terms.
5. Privacy & Data Use
Your use of Metpow Services is also governed by our Privacy Policy. By agreeing to these Terms, you also agree to our Privacy Policy.
6. Payment Processing and App Store Terms
Payment processing for in-app purchases or subscriptions is handled by Stripe or applicable app store payment providers, acting on behalf of the site operator.
Where applicable, users agree to the app store’s default End User License Agreement (EULA) unless superseded by this document. If Metpow Ltd specifies a custom EULA during app setup, those terms will apply in full to all app interactions.
Metpow Ltd is not liable for any third-party services purchased or accessed by incorrect use of the application or that may be brought about by 3rd party apps or services.
7. Refunds
7.1 End-User Refunds
We aim to process refund requests within 14 days of receiving a complete request.
Requests must:
Contain necessary evidence (e.g., photos, purchase records, malfunction description)
Be submitted via our support channels
Refunds are subject to:
Manufacturer warranty terms
Return of the product in the agreed condition
A reasonable investigation period by Metpow (no fixed time frame)
Refunds will not be provided for:
Network or power outages resulting from third-party issues or infrastructure managed by the site owner or monthly-fee-paying customer.
If a payment fails or is reversed (e.g., via chargeback), your access to services may be suspended until the balance is resolved. You remain liable for charges incurred before suspension.
8. Availability
Metpow aims to offer reliable service, but we do not guarantee uninterrupted access. Scheduled maintenance may occur.
Metpow acts as a service and billing provider on behalf of third-party site operators (e.g., marinas, campsites). We are not responsible for infrastructure failures, supply interruptions, or meter malfunctions that originate from site-owned hardware or utilities.
9. Intellectual Property
All software, firmware, content, and designs are owned by Metpow Ltd. You may not use them outside of licensed purposes.
10. Limitation of Liability
We are not liable for indirect or consequential losses. Maximum liability is limited to the amount paid to us by you in the previous 12 months.
We do not exclude liability for death, personal injury due to our negligence, or anything that cannot legally be excluded.
11. Termination
We may suspend or terminate service for misuse or breach. You may stop using the services at any time.
12. Changes to These Terms
We may update these Terms periodically. Updates will be posted at www.metpow.com. Continued use signifies agreement.
13. Governing Law
These Terms are governed by English law. Disputes will be handled in the courts of England and Wales.

2. GDPR and Transparency Statement
Metpow Ltd processes personal data under the UK General Data Protection Regulation (UK GDPR) and the EU GDPR, where applicable. This includes data about individuals' usage of utilities, connected devices, and payment activity.
3. Stripe Data Handling
For users making payments via Stripe, personal data such as name, email, payment method, and transaction metadata will be processed by Stripe on Metpow’s behalf in line with their role as a data processor and in accordance with their privacy terms. Stripe may also process certain data as an independent controller — see their Privacy Policy for more details.
4. Refund Evidence Handling
When a user submits a refund or complaint request, we may process supporting data including documents, photos, correspondence, and device diagnostics to verify the claim.
These are processed in accordance with our existing principles of data minimisation and legal basis for service performance.
